We have tried to write them in plain language, but where a clause is necessarily legal, we have left it legal rather than pretend it is not. By using the site you agree to these Terms, together with our Privacy Policy and Cookie Policy.
Acceptance of Terms
These Terms of Use govern your access to and use of the Nacho Tea website (available at www.nachotea.com), together with the free resources we publish on it — including the Marketing & PR Jargon Translator, our free Marketing & PR Translator e-book, and our newsletter. By accessing or using the site, you agree to be bound by these Terms and by our Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree with these Terms, please do not use the site. Where a clause below is necessarily legal, we have kept it legal rather than dress it up as something it is not.
Who We Are
Nacho Tea is a creative marketing, public relations and brand-strategy studio. We help companies find a sharper position, a clearer message and a story their market can understand. We are the data controller in respect of the personal data described in our Privacy Policy, and we are the operator and publisher of this website for the purposes of these Terms. Using the Site
You may use the site for lawful, personal or business research and inspiration. In return, you agree not to misuse it. Specifically, you agree not to: (a) use the site or its tools to do anything unlawful, fraudulent or misleading; (b) attempt to gain unauthorised access to our systems, accounts or data, or to interfere with the site's security or performance; (c) scrape, harvest or systematically copy the site or the glossary at scale, or use automated means to extract its content for a competing product; (d) pass off our content, brand or tools as your own; or (e) upload or submit anything that is defamatory, infringing, obscene or otherwise unlawful. We may suspend or block access where we reasonably believe the site is being misused. These Terms do not grant you any rights in our trademarks, content or software beyond what is expressly stated here.
Intellectual Property
Unless we say otherwise, all content on this site — including our writing, the Jargon Translator and its structure, our brand, logos, designs and code — is owned by Nacho Tea or its licensors and is protected by copyright and other intellectual-property laws. You may view, link to and quote small portions for commentary or reference, provided you attribute Nacho Tea and do not imply endorsement. You may not republish, resell, or systematically reproduce the site or the glossary, nor present our work as your own. The free e-book is licensed to you for your own use and may not be redistributed or sold.
The Jargon Translator & Free Resources
The Jargon Translator, the free e-book and similar resources are provided free of charge for general guidance. They are not a substitute for tailored professional advice, and they are provided "as is" and "as available", without warranty of any kind. Marketing, PR and brand strategy depend on context; a definition or framework that is right for one company may be wrong for another. Use the tools to sharpen your thinking, not as a compliance or legal instruction.
User Contributions
A feature of the Jargon Translator lets you suggest new terms for the glossary. Where you submit a suggestion, term, definition or message, you confirm that it is your own original work (or that you have the right to submit it) and that it does not infringe anyone else's rights. To the extent needed to run and improve the Translator, you grant Nacho Tea a non-exclusive, royalty-free, worldwide licence to use, edit, publish, credit and display your contribution on the site and in related materials. We are not obliged to publish every suggestion, and we may remove contributions that are off-topic, inaccurate or unlawful. Any personal data you include in a suggestion is handled in line with our Privacy Policy.
Disclaimers
To the fullest extent permitted by law, the site and everything on it are provided without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement or accuracy. We do not warrant that the site will be uninterrupted, error-free or secure, or that defects will be corrected. Where we express an opinion — about marketing, PR or brands — it is ours, and you rely on it at your own risk. Nothing on the site constitutes legal, financial or professional advice specific to you.
Limitation of Liability
To the maximum extent permitted by law, Nacho Tea and its founders will not be liable for any indirect, incidental, special or consequential loss, or for any loss of data, revenue, goodwill or opportunity, arising out of or in connection with your use of (or inability to use) the site or its free resources, even if we have been advised that such loss might occur. Our aggregate liability to you, where it cannot be excluded, is limited to the amount you have paid us (which, for a free site, is nothing). We may update these Terms from time to time as the site and our services evolve. When we do, we will update the "Last changed" date at the top of this page, and — where a change is significant — we will draw it to your attention where we reasonably can. Your continued use of the site after a change takes effect constitutes acceptance of the revised Terms to the extent permitted by law.
